What Is Considered a Violent Crime?

The label “violent crime” covers various types of offenses that involve force, harm, or aggression against others.

The U.S. Bureau of Justice Statistics lists violent crimes as:

  • Assault and battery
  • Rape
  • Robbery
  • Carjacking
  • Armed burglary
  • Manslaughter
  • Kidnapping
  • Spousal and child abuse
  • Unlawful imprisonment
  • Negligent or reckless homicide
  • Murder and attempted murder

These crimes include both attempted and concluded acts. In every case of a violent crime, the prosecutor must be proven beyond a reasonable doubt each element of the crime as defined by law.

For example, murder includes malice aforethought before the action took place; this means that the alleged offender intended to commit the crime before doing so. This malice must then be proven by the prosecution to convict the accused of murder. While it may be easy to prove that the accused killed the victim, it may not be so easy to prove the element of malice.

How Are Violent Crimes Punished?

Most violent crimes are charged as felonies. The penalties will depend on what type of crime is involved, the severity of any injuries inflicted, and your prior criminal history, if any. Convictions can lead to short or long-term prison sentences (including up to life imprisonment), fines, and probation. Upon release from prison, you will have a permanent criminal record labeling you as a violent person. This will make it difficult to gain employment, housing, and educational opportunities, or to pursue careers requiring a professional license.
