Charges Resulting From Sacramento Mass Shooting

Mass shootings continue to be a problem in the country, and California is no exception. The most recent tragedy occurred in Sacramento, where police are looking for multiple suspects involved in a mass shooting in the city’s central business area early Sunday that killed six people and wounded 12 others.

According to the Los Angeles Times, the shooting occurred about 2 a.m. following a large fight that broke out in a popular entertainment district. The newspaper quoted Police Chief Katherine Lester saying officers heard gunfire and arrived at the scene at 10th and K streets, roughly two blocks northwest of the state Capitol, where they found multiple shooting victims.

No additional information is about this tragedy other than the police chief saying someone drove up to 10th street and “unleashed a sustained barrage of bullets” into a crowd of people before fleeing. The chief also says there was a second shooter who opened fire, but it is not clear whether the person was with the other shooter or in the crowd.

“This is a really complex and complicated scene,” the police chief said, adding, “And there is a process and what we want to do is make sure that this investigation is completed thoroughly and accurately because we do want to see the perpetrators of this crime brought to justice.”

According to another news source, at least five men were involved in the shootout, and it is believed gang violence played a role in the shootout.

Criminal Charges for Mass Shootings in California

Police have now arrested Dandre Martin, 26, and had him booked for assault and illegal firearm possession, according to a statement issued by the Sacramento Police Department. Martin’s brother, Smiley Martin, who was seriously injured in the shootout, was also arrested Tuesday on suspicion of multiple weapons-related felonies.

The police said in the statement once Martin’s brother is discharged from the hospital, he will be taken straight to Sacramento County Jail, where he will be booked for the multiple weapons charges, including possession of a firearm by a prohibited person and possession of a machine gun.

However, given the violence and deadliness of this heinous criminal act, one can certainly expect the police to charge this suspect and others with additional charges, which may include the following:

  1. Murder
  2. Attempted murder
  3. Conspiracy to commit murder
  4. Assault with intent to commit a felony

Because it is being reported that gang violence may have played a role in this mass shooting, the prosecutors may charge the suspects under Penal Code 186.22 as well. This is a California law that prohibits criminal street gang activity. A person can be prosecuted under this section of the law if they are either involved as a member of a gang while furthering a felony, or they commit a crime for the benefit of a gang.
